Terms and conditions for the use of Aigolex.

1. Introduction

These Terms and Conditions ("Terms") govern access to and use of the Aigolex platform ("Aigolex", "the Service").

Aigolex is a software platform designed to support organizations in managing and documenting compliance processes related to artificial intelligence systems.

By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree, do not use the Service.

2. Provider

The Service is currently provided by:

Aigolex
Bologna (BO), Italy

The Service is offered during a pre-incorporation phase. A formal legal entity will be established and will automatically assume all rights and obligations related to the Service.

3. Nature of the service

Aigolex is a software tool that enables users to:

  • organize AI-related assets and deployments
  • document compliance processes
  • track obligations related to the EU AI Act

Aigolex:

  • does not provide legal advice
  • does not guarantee regulatory compliance

Any decisions made based on the Service are the sole responsibility of the user.

4. User roles

The Service supports different types of users, including:

  • Companies (customers)
  • Consultants (external collaborators)

Consultants:

  • may access multiple companies
  • may act on behalf of companies depending on assigned permissions
  • are currently not charged, but Aigolex reserves the right to introduce pricing for consultants at any time

Each company remains solely responsible for:

  • its data
  • its compliance status
  • actions performed within its account

5. Account registration

To use the Service, users must create an account.

Users agree to:

  • provide accurate and complete information
  • maintain the security of their credentials
  • be responsible for all activities under their account

6. Free trial and access

Companies may be granted a free trial period (e.g. 14 days).

After the trial:

  • continued use requires a paid subscription (managed offline)
  • Aigolex may restrict or block access if no agreement is reached

When access is restricted:

  • users may retain read-only access
  • modification, export, or detailed interaction may be disabled

7. Payments

At this stage:

  • pricing is defined through offline agreements
  • no automated billing or self-service checkout is provided

Aigolex reserves the right to:

  • change pricing models
  • introduce automated billing in the future

Failure to complete payment may result in:

  • suspension or limitation of access

8. Data and responsibility

Users retain full ownership of their data.

The user (company) is solely responsible for:

  • the accuracy of all information entered
  • ensuring that their data reflects real-world compliance

Aigolex:

  • does not verify user-provided data
  • is not responsible for errors, omissions, or outdated information

9. Data sensitivity

The Service may contain:

  • information about AI systems
  • internal operational data
  • compliance-related documentation

Users are responsible for ensuring that:

  • they have the right to upload such data
  • no laws or third-party rights are violated

10. Acceptable use

Users agree not to:

  • misuse the Service
  • attempt unauthorized access
  • reverse engineer the platform
  • use the Service for unlawful purposes

Aigolex reserves the right to suspend accounts that violate these rules.

11. Availability and changes

Aigolex may:

  • modify, update, or discontinue features
  • introduce new functionalities
  • change the structure of the Service

The Service may include:

  • beta or experimental features
  • features that may change or be removed without notice

12. Suspension and termination

Aigolex may suspend or terminate access:

  • in case of non-payment
  • in case of misuse
  • at its discretion if necessary to protect the Service

Users may terminate their account at any time.

13. Data retention after termination

Upon termination:

  • data will be retained for a grace period
  • after the grace period, data may be permanently deleted

Users are responsible for exporting their data before deletion.

14. AI Act and compliance disclaimer

Aigolex supports compliance workflows related to the EU AI Act, but:

  • does not certify compliance
  • does not act as a notified body
  • does not replace legal, regulatory, or professional advice

Compliance remains entirely the responsibility of the user.

15. Limitation of liability

To the maximum extent permitted by law:

  • Aigolex shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or data
  • total liability shall not exceed the amount paid by the user in the 12 months preceding the claim

16. No warranty

The Service is provided "as is" and "as available".

Aigolex makes no guarantees regarding:

  • uninterrupted operation
  • accuracy of outputs
  • fitness for a particular purpose

17. Future changes

Aigolex may update these Terms at any time.

Continued use of the Service after changes means acceptance of the updated Terms.

18. Governing law and jurisdiction

These Terms are governed by the laws of Italy.

Any dispute shall be subject to the exclusive jurisdiction of the courts of Bologna (BO).
